Plaintiff, as administrator of the estate of Arthur V. Neff, deceased, brought this action to recover a ten-year accrual of disability payments to which the decedent was allegedly entitled at the time of his death under the terms of a life insurance policy, and to recover also the amount of the annual premiums on the policy which the decedent paid during said period. Issue was joined upon plaintiff's second amended complaint, which pleaded, as successive causes of action, defendant's fraud and mistake in its representation of the insured's rights under the disability clause of his
